Terms of Service
Last updated October 30, 2026
These terms explain what you can expect from FunnelApp and what we expect from you. They are written in plain language because you should be able to read the agreement you sign.
Our Privacy Policy explains how we handle personal information. It forms part of these terms.
1. The agreement
These terms are an agreement between you and LaunchOut Digital, 700 University Avenue, Toronto, Ontario M5G 1X6, Canada, which owns and operates FunnelApp ("FunnelApp", "we", "us"). By creating an account or using FunnelApp, you accept them. If you use FunnelApp for a business, you accept them for that business and confirm you can bind it. In these terms, "you" means you and that business.
You must be at least 18 and able to enter a contract to open an account.
2. Your account
Give us accurate details and keep them up to date. Keep your sign-in details safe. You are responsible for everything done in your account, including by people you let use it. Tell us straight away if you think someone has got into your account without permission.
3. What FunnelApp does
FunnelApp lets you build and host sales funnels: lead magnet and opt-in pages, offer and checkout pages, upsells, thank-you pages, video pages, applications and follow-up emails. It includes AI drafting, Copilot, payment connections, ad tracking and reporting.
We may improve, change or remove features over time. If we remove something you pay for, we will tell you in advance.
4. Your content and your leads
You own what you put into FunnelApp: your pages, offers, emails, images, videos, testimonials, and the leads and customers your funnels collect. You give us a limited permission to host, copy, process, display and send that content only as needed to run FunnelApp for you. That permission ends when your content is deleted, except for copies we must keep by law.
You confirm you have the rights to everything you upload or publish, including images, videos, logos, music, testimonials and the names of anyone you quote.
5. AI drafts
FunnelApp uses AI to write drafts of pages, offers and emails, and to answer questions in Copilot. AI can be wrong, incomplete or too confident. It can produce text that resembles existing material.
Treat every draft as a starting point. Read and edit it before it goes live. You are responsible for what you publish, including every claim, price, guarantee, result and testimonial. As between you and us, you own the drafts FunnelApp writes for you, to the extent the law allows.
6. Your duties to your leads and buyers
Your funnels are your business. When you collect personal information and sell through FunnelApp, you are responsible for following the law that applies to you and your buyers. That includes:
- Having a lawful basis and any consent you need before you email someone. In Canada that means following Canada's Anti-Spam Legislation (CASL). In the US, CAN-SPAM. In the EU and UK, the GDPR and the rules on electronic marketing.
- Identifying your business in your funnels and emails, and including any contact details the law requires.
- Honouring unsubscribe and deletion requests promptly. FunnelApp handles unsubscribe links for you. Do not re-add people who have left.
- Having your own privacy notice for your funnels where the law requires one, and telling people how you use their details.
- Turning on ad tracking only where you are allowed to, and keeping the consent banner on where the law requires it.
- Delivering what you sell, handling your own refunds, chargebacks and customer service, and charging and paying any taxes on your sales.
- Making sure every claim, testimonial and guarantee is true and that you can back it up.
7. How we handle your leads' data
When we process personal information about your leads and buyers, we act on your behalf. We will:
- Process it only to provide FunnelApp to you, following your settings and instructions, unless the law requires otherwise.
- Keep it confidential, and make sure anyone who works on it is bound to keep it confidential.
- Protect it with reasonable security measures.
- Use only the service providers listed in our Privacy Policy, under contracts that protect the data, and update that list when it changes.
- Tell you without undue delay if we learn of a breach that affects it.
- Help you answer requests from your leads to see, correct or delete their data.
- Delete it when you delete it, or within 30 days of your account closing, except where the law requires us to keep it.
If you need a signed data processing agreement for the GDPR or UK GDPR, email us.
8. Acceptable use
Emails from your funnels go out through FunnelApp's sending domain, so one sender's behaviour affects every customer. You may email only people who signed up through your funnel or who gave you clear permission. Do not import or upload lists you bought, rented, borrowed or scraped.
You may not use FunnelApp to:
- Sell or promote anything illegal, or anything that needs a licence you do not have.
- Make false or misleading claims, including income, earnings or get-rich-quick promises you cannot back up, and health claims that a product cures, treats or prevents disease.
- Run pyramid schemes, deceptive investment or crypto offers, gambling, or adult sexual content.
- Sell weapons, drugs, tobacco or vaping products, or prescription products.
- Collect passwords, government ID numbers or card numbers outside Stripe checkout.
- Send spam, phishing or malware, or pretend to be someone else.
- Infringe anyone's copyright, trademark or other rights.
- Harass, threaten, discriminate against or exploit anyone, or target children.
- Break, overload, probe or get around the security or limits of the service, or copy FunnelApp to build a competing product.
We may pause sending, take a funnel offline, or suspend an account that breaks these rules or puts the service, other customers or the public at risk. Where we reasonably can, we will tell you first and give you a chance to fix it. Sending also pauses on its own when bounces or spam complaints run high.
9. Taking payments
Payments from your buyers go through your own Stripe account, connected to FunnelApp, or through a payment link you add. Your buyers pay you, not FunnelApp, and FunnelApp takes no fee on your sales. Stripe's own terms apply to your Stripe account and its fees.
You are the seller. You are responsible for your prices, your refund policy, taxes on your sales, disputes and chargebacks.
10. Plans and billing
Plans renew every month or every year on the day you started, through Stripe, until you cancel. Yearly plans are paid once a year, up front. Prices are in US dollars and don't include any sales tax your country adds.
Upgrades start straight away. You pay the difference for the rest of the period you paid for. Downgrades and cancellations take effect at the end of the period you paid for. Moving from monthly to yearly starts a new year from that day, with the unused part of your month taken off the first payment. Moving from yearly to monthly happens when the paid year ends.
Monthly allowances (AI generations, emails, Copilot messages, video streaming) reset on the 1st of each month, UTC, on monthly and yearly plans alike, and don't roll over. You're never charged extra for going over. Work that doesn't fit waits: emails stay queued, new uploads wait for room, and drafts are always kept.
If a payment fails, Stripe retries your card and your plan keeps working for 14 days. After that the account works as Free until the card is updated.
After a downgrade or cancellation nothing is deleted. Extra live funnels stay live for 14 days so you can choose which to keep, then the ones with the fewest sales and leads go back to draft. Uploaded videos keep playing for 7 days, then pages use your pasted video link. Video streaming is measured by Cloudflare and pages keep playing until use passes the allowance by 10%.
The Free plan shows a small "Made with FunnelApp" note on funnel pages. Launch is $19, Grow $49 and Scale $99 USD a month, or $180, $468 and $948 USD a year.
We may change our prices. A price change applies from your next renewal after we have told you about it at least 30 days in advance.
11. Cancelling and refunds
You can cancel at any time from Usage and billing, and you keep your plan until the end of the period you paid for. There are no refunds for part of a month or part of a year.
If you were charged by mistake, or you upgraded and could not use the plan because of a fault on our side, email [email protected] within 14 days of the charge and we will put it right. This does not limit any refund right the law in your province or country gives you.
12. Other services
FunnelApp connects to services run by other companies, including Stripe, Meta, TikTok, Google sign-in and booking tools. Your use of them is governed by their terms. We are not responsible for those services, their availability or changes they make that affect FunnelApp.
13. Our property and your feedback
FunnelApp, its software, design, templates, playbooks and brand belong to LaunchOut Digital. These terms give you the right to use them while your account is open. They do not transfer ownership.
If you send us ideas or feedback, we may use them freely without owing you anything.
14. Availability and disclaimers
We work to keep FunnelApp running, fast and secure. But the service is provided as it is and as available. To the extent the law allows, we do not promise that it will always be available, free of errors or right for your purpose.
We do not promise any level of leads, sales or revenue. Results depend on your offer, your traffic and many things outside our control.
Keep your own copies of anything important, such as your lead list.
15. Limits on liability
To the extent the law allows:
- FunnelApp is not liable for lost profits, lost sales, lost data, lost goodwill, or any indirect, incidental, special or consequential loss.
- Our total liability for all claims relating to FunnelApp is limited to the greater of what you paid us in the 12 months before the claim and $100 USD.
Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud or for death or personal injury caused by negligence. If you are a consumer, you keep any rights consumer protection law gives you.
16. Your responsibility for claims
If someone makes a claim against FunnelApp because of your funnels, your content, your emails, your products, or your breach of these terms or the law, you will cover the reasonable costs, losses and legal fees that result. We will tell you about the claim promptly and let you take part in the defence.
17. Ending your account
You can stop using FunnelApp at any time. To delete your account and its data, email [email protected] from the address on the account. We will confirm and delete it within 30 days.
We may suspend or end an account that seriously or repeatedly breaks these terms, that does not pay, or where the law requires us to. Where we reasonably can, we will warn you first and give you time to save a copy of your leads.
Sections that by their nature should continue after an account ends, such as payment owed, liability limits and claims, will continue.
18. Changes to these terms
We may update these terms as FunnelApp grows. If a change is significant, we will tell you by email or in the app at least 14 days before it takes effect. If you keep using FunnelApp after that, the new terms apply. If you do not agree, you can cancel before they take effect.
19. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario, sitting in Toronto, have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim in your local courts.
Before starting any formal claim, please email us and give us 30 days to try to resolve it. Most problems get solved that way.
20. General
These terms and the Privacy Policy are the whole agreement between us about FunnelApp. If part of them cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your account without our written permission. We may transfer these terms as part of a merger or sale of the business. Neither of us is responsible for delays caused by events outside reasonable control.
If these terms are translated, the English version governs, to the extent the law allows.
